Holiday Contract

Your contract is with Dar Surf, SARL, located at RUE TASGA OUDRAR, TAGHAZOUT, MOROCCO. The person signing the booking form must carefully read and accept these Booking Conditions. For group bookings, the group leader or ‘lead name’ assumes authority to sign on behalf of all members, being responsible for the full holiday cost, insurance, cancellations, and amendments. A booking contract with Dar Surf is confirmed upon receipt of the completed booking form and a 30% deposit made by the customer. We reserve the right to decline bookings at our discretion without providing a reason. Please notify us promptly of any discrepancies in booking details or costs.

Trip Risk Acceptance: Essential Pre-Arrival Agreement

Before your arrival, please carefully read and agree to our risk acceptance waiver, as it is a condition of entry onto each trip. At Dar Surf, we acknowledge that all trips/tours entail inherent risks that may not be typical of conventional or less active holidays. By accepting the risks involved, passengers affirm that their decision to travel was made with due consideration of relevant travel information, releasing Dar Surf and the service provider from any liability.

Travel Arrangements and Liabilities

Dar Surf may act as an agent for travel services, such as Marrakech transfers (not provided by Dar Surf). While arranging these services, Dar Surf accepts no liability for any injury, loss, damage, accident, delay, irregularity, or incurred costs that may arise for passengers or third parties due to their use. Additional booking conditions may apply to certain service providers (e.g., Transfer Companies). As agents for these providers, we do not take responsibility for any omissions, defaults, neglect, or accuracy of information provided by them. Please be aware that some service providers may require additional booking forms for reservations to be completed.

Stable Pricing for Your Booking

Our prices are in euros, ensuring transparency for your holiday expenses. When making your booking, the price of your holiday is typically fixed, but we reserve the right to adjust prices if there are variations in service charges, insurance/security levels, or exchange rates. Please note that discounts cannot be applied retrospectively once a booking is confirmed.

Two-Step Payment Process

To secure your booking, follow our two-step payment process:

  1. A 30% deposit is required after completing the booking form and confirming with one of our agents. The deposit should be made via bank transfer. Any arising bank transfer or currency exchange fees are to be covered by the client. Please note that the deposit is non-refundable after confirmation.

  2. The remaining balance will be paid in cash (Euros or Dirhams) upon check-in in Morocco.

Dar Surf reserves the right to cancel a reservation after written reminder by e-mail if the down payments is not paid on time.

Cancellation Policy

Should you need to cancel your booking, please notify Dar Surf immediately. The following sliding scale determines the refundability of your holiday:

  • Cancellation over 30 days before arrival – 50% of the deposit holiday cost retained
  • Cancellation 30 to 8 days before arrival – 75% of holiday cost retained
  • Cancellation less than 7 days before arrival – 100% of holiday cost retained
  • No show (not present on the day of arrival) – 100% of holiday cost retained

In certain circumstances, Dar Surf may cancel your holiday. However, we guarantee not to cancel your holiday within 8 weeks of the scheduled departure, except for ‘force majeure’ reasons, such as war, political unrest, strikes, acts of God, epidemics, natural and technical disasters, port or aircraft closures, or client default in balance payment. In such cases, we will offer you a valid voucher for 12 months.

At Dar Surf S.A.R.L, we highly recommend third-party travel insurance covering cancellation costs. We do not assume responsibility for any financial losses resulting from trip cancellation, as the responsibility lies with the service contractor.

Any changes to your holiday made by Dar Surf are infrequent but may occur. Most changes are minor and will be communicated to you as early as possible.

Please note that under any circumstances, the total reserved amount will not be reimbursed if the client cancels during the booked period. The deposit amount will not be refunded in case of vacation cancellation by the contractor.

Our contract with you is established at Dar Surf’s offices in Tasga Oudrar, Taghazout, Morocco. All our conditions are subject to Moroccan Law.

For pre-contracted activities or services, Dar Surf does not offer refunds or exchanges if the client cancels or fails to attend the booked activity or service during their stay. In case of a medical problem, we will assess the situation and either arrange alternative activities or services or provide a refund if changes are not possible.

Dar Surf’s Guarantee

At Dar Surf, we take full responsibility to ensure that the holiday you book with us aligns with the descriptions provided on our website, brochure, and other marketing channels. We strive to deliver services of a reasonable standard and quality. If any aspect falls short of our promises and negatively impacts your holiday experience, we are committed to providing appropriate compensation to address any inconvenience caused.

Start and Finish with Adventure

Your Dar Surf holidays begin and end as stated on your invoice or booking confirmation. Please note that we are not responsible for your travel arrangements to or from this point, nor for any associated expenses, including travel, accommodation, subsistence, or loss of earnings incurred due to delayed return to your departure point, regardless of the cause.

For your convenience, we offer several online channels through which you can book your Dar Surf experience.

For late check-ins occurring after 10:00 PM, we apply a nominal fee of 10€. Embrace the excitement of your journey, knowing we’ll be here to welcome you!

Smooth Airport Transfers

For your airport transfers, we occasionally collaborate with a local agency, ensuring your departure times align with your flight schedule, typically set at 3 hours before your departure from the accommodation.

Please note that transfers not bound for Agadir airport are booked on your behalf, creating no contractual relationship between Dar Surf and the client for this service. Payment for such services should be made directly to the service provider. Dar Surf assumes no responsibility for any incidents of injury, loss, damage, accident, delay, irregularity, or associated costs arising from the use of these services. While we do our best, we cannot guarantee precise arrival or departure times, nor can we be held liable for any missed connections to other services.

Surf Guiding Acknowledgment

As you join us on our surf excursions, please understand that Dar Surf is providing guidance to surf beaches for informational purposes only. This guidance is not intended as expert advice or opinion, nor should it be relied upon as surfing or safety advice. We want to emphasize that Dar Surf assumes no responsibility for clients’ safety or any incidents of injury or harm while surfing.

Responsible Conduct

During your stay with Dar Surf, we kindly request that clients maintain orderly and acceptable behavior, taking responsibility for themselves and their party. In the event that their conduct jeopardizes the condition of the accommodation or vehicles or significantly disrupts the enjoyment of other guests, Dar Surf reserves the right to decline further accommodation for the responsible party, leading to termination of contractual obligations. Additionally, the party at fault will be held liable for any incurred damages.

Reporting Complaints and Claims

For any complaints or claims during your holiday, please promptly report them to the relevant supplier responsible for the issue and also notify our Dar Surf representatives. This gives us the opportunity to address and resolve the problem immediately. Please be aware that we cannot accept liability if we are not informed of any issues during your stay. If any complaints are not fully resolved on-site, kindly submit them in writing within 28 days of the holiday’s conclusion. Claims received after this period may not be accepted.

Essential Travel Insurance

To ensure a secure and worry-free holiday experience, all guests booking with Dar Surf must have comprehensive travel insurance. Please be aware that Dar Surf does not assume responsibility for any loss, theft, or damage to persons or property during your stay. We highly recommend obtaining your insurance independently to safeguard your well-being and belongings throughout your adventure with us.

Unpredictable Weather & Surf Conditions

Should there be instances of poor weather or unfavorable surf conditions, passengers acknowledge and agree not to hold Dar Surf or the operators liable for any claims or demands.

If you wish to make a complaint or claim whilst on holiday you must report it to the relevant supplier of the problem in question and to our Dar Surf representatives, thereby giving them the opportunity to remedy the problem. We cannot accept any liability whatsoever if we are not informed immediately, of any problem during your stay. Complaints not resolved completely in resort should be made in writing within 28 days of the end of the holiday. We will not accept liability for claims received after this period.

Prioritize Your Well-being: Fitness Responsibility

Prior to embarking on your surf trip or yoga retreat, it is essential to ensure your fitness level aligns with the requirements of the journey. We advise consulting your doctor for personalized health recommendations concerning travel to the region and addressing any pre-existing health concerns. Dar Surf may request a current medical certificate to verify your fitness for the trip. Please be aware that any medical expenses or related costs during your trip are not the responsibility of Dar Surf.

Passport and Visa Responsibility

As a passenger traveling with Dar Surf, it is your responsibility to possess a valid passport and obtain the necessary visas. Please ensure that your passports remain valid for a minimum of 6 months beyond your scheduled date of arrival for the trip or tour.
